A few weeks ago, I wrote about Arcads—a platform that promised to revolutionize User-Generated Content (UGC) by letting AI clone your likeness for marketing campaigns. I was very optimistic, I mean it sounds cool: Imagine democratizing content creation! Empowering small businesses! Bridging authenticity and tech! But then came the contract. Once I got. the contract though, that optimism shifted. Turns out it’s all doom and gloom.
As someone who champions AI’s potential to enhance creativity, not exploit it, I want to dissect why this agreement left me equal parts baffled and uneasy—and why creators deserve better.
The 150 Question: What Are You Really Signing Away?
150 USD to license 10 years of a digital clone . That’s the offer. The contract is far more predatory than I expected it to be for such a low number. For less than the cost of a premium blender, Arcads asks you to surrender:
- Global, indefinite rights to your likeness, voice, and intellectual property.
- Liability waivers that leave you holding the bag if clients misuse your AI clone (think deepfakes, hate speech, or worse).
- Exclusivity clauses barring you from working with competitors (19 listed companies!) for six months post-termination.
If we really let that sink in and process. You’re not just licensing your image—you’re signing away control over how it’s used, who profits, and what happens when things go sideways. And for what? A one-time fee that barely covers dinner for two.
The Fine Print: Liability Loopholes & Ghost Clones
The most jarring clause? “FRESHR (Arcads) declines all responsibility in the event of illegal or illicit use of my image by its Clients.” Translation: If a client turns your AI twin into a crypto-scam avatar or a political deepfake, you—not Arcads—must chase legal recourse. The platform washes its hands, despite monetizing your likeness. In fact, there’s a section of the contract where they explicit say they can in no way be held accountable but YOU will in their place assume liability. Crazy work for a 150 payout on a 10 year exclusivity deal for a digital clone of you that can be made to say almost anything.
Even after termination, your “Cloned Replica” might linger indefinitely on social media, training datasets, or client archives. Arcads “does its best” to remove it but admits total erasure is “difficult.” Imagine your digital ghost haunting the internet long after you’ve moved on.
Ethical AI Isn’t Just About Tech—It’s About Fairness
Let me be clear: I’m not anti-AI.
Cloning tools could empower creators, amplify diverse voices, and democratize storytelling. But innovation without accountability isn’t progress—it’s exploitation.
When companies like Arcads prioritize profit over protection, they risk normalizing a system where creators are interchangeable, undervalued, and disposable. For AI to earn public trust, platforms must:
- Compensate fairly—$150 for perpetual rights is a slap in the face.
- Assume accountability—don’t outsource liability to individuals.
- Offer transparency—clones shouldn’t outlive their creators’ consent.
A Call to Creators: Know Your Worth
To my fellow creators: Your likeness isn’t a commodity. It’s your identity, your artistry, your legacy. Before signing any AI agreement, ask:
- Who owns my data after the contract ends?
- What safeguards exist against misuse?
- Is this payment reflective of the value I’m providing?
And to companies like Arcads: Do better. AI’s greatest promise lies in uplifting humans, not reducing them to cheap, expendable inputs. Pay creators fairly. Protect them vigorously. Build tools that respect dignity as much as disruption.
Conclusion: The Future of UGC Shouldn’t Feel Like a Black Mirror Episode
I still believe AI can transform marketing for the better—but not like this. Arcads’ contract isn’t just a bad deal; it’s a cautionary tale. As we navigate this brave new world, let’s demand innovation that honors authenticity, accountability, and the humans behind the pixels.
After all, the line between “cutting-edge” and “dystopian” isn’t drawn by technology—it’s drawn by the choices we make.
Be curious. Be critical. And above all, be authentic.
